Canada’s Immigration Changes 2024:
What You Need to Know

Immigration policies in Canada are continuously evolving, with significant updates throughout 2024 introducing stricter regulations across various programs. These recent changes are now in effect, making it crucial for workers, students, and employers to rethink their immigration strategy and next steps accordingly.

Key Changes and Their Impact

1. Stricter LMIA Requirements

Employers looking to hire foreign workers must now meet higher wage requirements and navigate stricter approval conditions.  The LMIA validity period has been reduced, meaning employers must act quickly once approval is granted. Additionally, if the unemployment rate in a metropolitan area is 6%, the LMIA application will be refused.  High-wage positions must now offer a salary higher than the prevailing wage to qualify.  If you are an employer, it’s essential to start planning early.

2. Shortened Work Permit Duration for Low-Wage Jobs

Work permits under the Temporary Foreign Worker Program for low-wage positions are now being issued for only one year. This makes renewal planning critical for both workers and employers.

3. More Restrictions on Study Permits

The Canadian government is tightening rules on study permits, which include caps on the number of permits issued. This makes early application and strong supporting documentation more important than ever for prospective international students.  In addition, new restrictions have been introduced on work permits for spouses of international students, limiting eligibility based on certain conditions.

What These Changes Mean for You

  • If You Are an Employer: Start your LMIA applications earlier and ensure compliance with the latest requirements to avoid delays. The LMIA validity period has been reduced to six months, and the high-wage requirement now demands a salary higher than the prevailing wage. Additionally, be aware that LMIA applications may be refused in metropolitan areas with an unemployment rate of 6% or more.

  • If You Are a Worker: If you are on a work permit, now is the time to plan your next steps to maintain legal status in Canada. With tighter restrictions on certain work permits, especially for spouses of international students, early planning is essential.

  • If You Are a Student: If you are considering studying in Canada, preparing a well-structured application is now more crucial than ever. Caps on study permits and changes to work permit eligibility for spouses mean that careful planning and strong supporting documentation are key to a successful application.
